Winston Salem | Some Mistakes Sellers Make


In today's market,  we have to have a different mindset from a few years ago.   We are not seeing multiple offers as before.   However, there are buyers out in the market waiting on inventory.

Here are a couple of killers, we are seeing. 

Being Unwilling to Negotiate:
Some sellers may be rigid in their pricing and terms, refusing to negotiate with potential buyers. Flexibility can often lead to a successful sale. Did you know there are many places in a contract to negotiate with, it's not always the sale price!
 
Ignoring Feedback:
If multiple potential buyers provide consistent feedback about issues with the property, such as pricing or condition, it's essential for sellers to take this feedback seriously and make necessary adjustments.

North Carolina Landlord Responsibilities for Habitability

Most places, including North Carolina, make a landlord responsible for the “habitability” of rental property. This means rental properties must be kept in proper condition to use for their intended purpose. Habitability is an important right for renters, but can be complicated because of details and differences in habitability requirements.

North Carolina Implied Warranty of Habitability

In North Carolina, the implied warranty of habitability means that a landlord must provide and maintain safe and habitable rental property. “Implied” means the requirement applies whether or not the lease agreement specifically says so and even if the lease tries to waive the obligation. 

Examples of clear habitability violations include:

  • Exposed electrical wiring.
  • A pipe leaking human waste.
  • A broken front doorknob that won’t lock.

However, the implied warranty of habitability does not guarantee that anything at the property will be pretty, clean, new or issue-free, so it doesn’t cover things like stained carpet or dents in a wall. It only guarantees basic health and safety.

Landlord Responsibilities in North Carolina

Note: Check local city/county laws and ordinances for additional requirements. Additionally, landlord and tenant can negotiate separate from the lease, for the tenant to do specific repairs after move-in, as long as the tenant gets compensation and isn’t required to do repairs as a condition of rental.

Winston Salem | What is the purpose of the seller obligations paragraph in our Purchase Contracts

Paragraph 8 in our Purchase Contracts lists a number of important things that the seller agrees to do in connection with the sale of the property. 

The list is not exclusive; the seller has other contractual obligations not listed in paragraph 8.

 • For example, the seller is obligated to convey any personal property described in paragraph 3 and to include all fixtures as a part of the sale unless excluded in paragraph 2. 

Paragraph 8(n) states that if the seller fails to “materially” comply with any of the obligations listed in paragraph 8, or materially breaches the contract, it gives the buyer certain rights. For more information, ask about the article on Breach of Contract.
